asked the Minister for Local Government if he will make a statement on the position of development plans of planning authorities in view of the recent High Court decision in the case of Finn v. the Bray Urban District Council.

The High Court decision referred to arose from an action to restrain the Bray Urban District Council from making a development plan which embodied an amendment, made in the light of public representations, of the provisions of their draft plan, as publicised. The judgment in the case, which has only come to hand in the past week, is being examined as to its implications for the making of development plans generally. Planning authorities will be advised in due course of conclusions which it is considered should be brought to their attention and if any additional measures are indicated they will be undertaken.
