Vol. 232 No. 2

Ceisteanna—Questions. Oral Answers. - Robbery with Violence Charge.

134.

asked the Minister for Justice why charges against a person (details supplied) were withdrawn; why the injured party and other witnesses of the alleged robbery with violence were not summoned to court; and, in particular, why the injured party was not notified in advance of the State's intention not to proceed or since of the reasons for the State's withdrawal of the charges.

The Deputy has been misinformed, apparently, in relation to the facts of the case. There were no witnesses of the alleged robbery other than the two persons directly concerned.

The withdrawal of the charges was carried out on the directions of the Attorney General, to whom the papers were submitted by the Garda Síochána when they had completed their inquiries and who decided that the evidence did not justify continuing with the prosecution.
