asked the Minister for Local Government if he will state, with reference to a reply of 13th March last, what amendments have been made to sections 39 and 44 of the Public Health Acts Amendment Act, 1907; by whom the statutory provisions should be enforced in the County Borough of Dublin; what remedies are available to persons injured by the non-enforcement of such provisions; if, having regard to the growing number of small late-night cafés in Dublin city with no or no adequate toilet facilities, he is satisfied with the present situation; and, if not, what steps he will take to remedy it.

Sections 39 and 44 of the Public Health Acts Amendment Act, 1907 have been amended by section 54 of the Local Government (Sanitary Services) Act, 1948; the enforcing authority for these provisions in the County Borough of Dublin is Dublin Corporation; the powers given to sanitary authorities in the sections referred to are discretionary and it would be open to a person to make representations to the sanitary authority to take action in any particular case. It is for the sanitary authority to judge whether such action should be taken.
