asked the Minister for Agriculture and Fisheries (a) whether marks were erected on the instruction of his Department to define the estuary at Laytown, County Meath, (b) if so, why, and (c) if he will quote the section of the relevant Act which authorised this to be done.

The answer to the first part of the question is "No". The remaining parts of the question do not, therefore, arise. For the information of the Deputy, I understand that these markers were erected by the Drogheda Board of Conservators for the guidance of fishermen and the Board's staff in relation to the area in which netting is prohibited under section 94 of the Fisheries (Consolidation) Act, 1959.

Can I take it as being untrue if representatives of the Drogheda Board of Conservators state that it was the officials of the Department who said where the marks should go and gave instructions about them?

The Deputy can take it that that is so.
