Ceisteanna—Questions. Oral Answers. - Dublin Corporation Notices.

28.

asked the Minister for Local Government if he is aware that notices are still being forwarded to Dublin Corporation tenants purporting to come from the Lord Mayor, Alderman and Burgesses of the City; and whether he will arrange in consultation with the City Commissioner that such notices will be corrected.

29.

asked the Minister for Local Government if he is aware of the fact that Dublin Corporation are using eviction notices in the name of the Lord Mayor, Alderman and Burgesses of the City of Dublin; and, if so, if the validity of these notices is affected by the fact that no such representatives of Dublin Corporation exist at the present time.

With your permission, a Cheann Comhairle, I propose to take Questions Nos. 28 and 29 together.

The members of Dublin City Council were removed from office by order made on 24th April, 1969. However, the Corporation of Dublin continues to exist as a local authority and bears the same title as it did before the removal of the members of the council i.e. "The Right Honourable the Lord Mayor, Aldermen, and Burgesses of Dublin". The use of this title in notices issued by the local authority is, therefore, in accordance with the law.

Has the Minister received any legal advice as to the correctness of these notices?

Yes. The title of the local authority has not been changed.

Has the Minister received any advice as to the whereabouts of the people he mentioned?

People? This is a title, not people.

Who is the Lord Mayor of Dublin?

John Garvin.

This is the corporate title of the local authority.

When the law was being framed no one thought there would be a dictator in the Department of Local Government.

This is not the first time that it was necessary to take action to ensure that the affairs of the city——

Who is the Lord Mayor of Dublin?

There is no such animal.
