asked the Minister for Local Government if he is aware of the objection by the Rockville Residents Association and the Avoca and Kingstown School Ltd. to a proposal to distribute mixed concrete from a plant at Newtownpark Avenue, Blackrock, Dublin; and if he will ensure that such a plant does not cause a nuisance to the residents or to the school authorities.

I have been furnished with a copy of a letter addressed to the planning authority on the 8th instant on behalf of these and other local bodies in connection with a permission granted by that authority for a proposed replacement of an existing concrete making plant at Newtownpark at Blackrock. I am asking the planning authority for a report in the matter.

Is the Minister aware that a large concern intend developing the premises on the planning permission given to an individual, in the first instance, in direct contravention of that permission? The residents association and school do not object to the planning as granted; what they object to is the probable change of use of these premises by planning for which permission was never sought. Would the Minister have these rather unusual transactions investigated?

That would not be a legitimate thing to happen, and the planning authority would be able to deal with any such unauthorised development.

Would the Minister take a personal interest in this serious situation?

It would be better for Deputies to do this, because it is possible the matter could come before me on appeal.

As I understand it, the permission is for the erection of a concrete block plant. What is intended is to erect a concrete liquid ready-mix plant which contravenes that permission.

If that is so, the planning authority have enforcement powers.
