asked the Minister for Local Government, in view of the failure of Dublin Corporation to deal with the complaints made to them regarding the pollution of the atmosphere in the vicinity of Markievicz House and O'Rahilly House due to the pulverisation of steel in the nearby scrapyard and the contamination of the air brought about by a local concern (name supplied), what steps he will take to see that these inconveniences which the public are suffering are brought to an end.

Responsibility for ensuring that any nuisance arising within their area is abated is a matter for the sanitary authority.

As regards any atmospheric pollution that may be arising out of operations at the scrapyard it is for the corporation to consider whether any action is open to them under the nuisance provisions of the sanitary services code or whether the control of atmospheric pollution regulations, 1970 which I made recently and which will come into operation on 1st January, 1971 would apply.

I understand that the corporation are already in correspondence with the second firm referred to with a view to having any nuisance that may be occurring at their premises remedied.
