Vol. 249 No. 5

Ceisteanna—Questions. Oral Answers. - Traffic Accident Compensation

113.

asked the Minister for Local Government if, having regard to the difficulty experienced by injured parties in recovering compensation for injuries and loss caused in traffic accidents arising from heart attacks of car drivers, he will ask the Motor Insurers Bureau to pay fair compensation to such injured persons.

The agreement which I have with the Motor Insurers' Bureau of Ireland is confined to cases where the courts give a judgment in favour of a person who has suffered personal injuries arising out of the negligent use of a motor vehicle by another person and there is no insurance to satisfy the judgment. I am advised that the bureau have considered one such case of the type referred to by the Deputy in which the absence of insurance was not a factor and have decided not to pay compensation on the grounds that the case did not come within the terms of the agreement to which I have referred.
