Vol. 251 No. 13

Ceisteanna—Questions. Oral Answers. - Fisheries Legislation.

40.

andMr. Kavanagh asked the Minister for Agriculture and Fisheries if he is aware that the way section 66 of the Fisheries (Consolidation) Act, 1959 is being applied in No. 8 fishing district (fresh water division) has resulted in several prosecutions in the Kerry-Limerick area; if he is further aware that in an appeal to the circuit court the decisions of the district court were reversed and the section in question was criticised by the circuit court judge; and if he will now consider introducing amending legislation.

I am aware of the prosecutions referred to and of the reversal on appeal of one of the decisions in question. I do not favour introducing amending legislation specifically on this point, but, if future developments seem to warrant it, I will have the matter considered with other items for inclusion in a future amendment Bill.
