Mr. Barry

asked the Minister for Defence if permission was given to block the fish pass on the weir at Ballincollig, County Cork which is his property; and when and to whom this permission was given.

No permission was given by my Department to block the fish pass in the centre of the weir at Inniscarra, Ballincollig. Unauthorised work was carried out to the weir and this involved the demolishing of the fish pass. The matter, which is in the hands of the chief state solicitor with a view to legal action being taken in respect of trespass on and damage to my Department's property, is still sub judice.
