asked the Minister for Social Welfare if he will explain why a doctor's certificate submitted by a person (details supplied) in County Donegal stating his fitness for work was not returned to him as requested on several occasions by the person concerned; and if he will make a statement on the matter.

The only request received in my Department for the return to the person concerned of the certificate referred to was contained in a letter received from him on 2nd June, 1971, in which he asked that the certificate be sent either to himself or to the local employment exchange. The request had not been finally dealt with at receipt of the Deputy's question because the letter quoted a wrong insurance number and did not indicate the reason for the request. It has since transpired, however, that the certificate would not in any event have been returned to the person because it was material to the decision of an appeal which had been made by him against the disallowance of his claim for unemployment benefit. The appeal was heard last Thursday and was rejected.
