asked the Minister for Social Welfare if he will state, in expansion of his reply of 7th July, 1970, regarding proceedings in the High Court arising from an appeal under the Social Welfare (Occupational Injuries) Act, 1966, (1) the date on which the appeal officer issued his decision to the appellant whose appeal was made on 21st January, 1969, (2) if the deciding officer's decision of 14th January, 1969 was based on direct or indirect medical evidence from his Department and (3) if his Department's medical adviser was in attendance at the oral hearing on 9th July, 1969; and if he will give details of the High Court judgment.

The further particulars requested by the Deputy are as follows:—

(1) 11th November, 1969.

(2) The deciding officer's decision of 14th January, 1969 was based on medical advice obtained by the Department from a specialist in cardiology.

(3) The reply to the first part of (3) is in the affirmative. Regarding the second part, it is not feasible to summarise details of the High Court judgment. A copy of the judgment is being placed in the Dáil Library for the benefit of the Deputy.
