asked the Minister for Local Government why planning exemption is not granted to owners of vested local authority houses who are putting in sewerage by way of septic tanks, although the added floor area is under the required limits; and if he will make a statement in the matter.

The provision of a septic tank is "development" within the meaning of the Local Government (Planning and Development) Act, 1963, and since this type of development is not specifically excluded from control under the Act or under regulations made under the Act, planning permission is required for the carrying out of such development regardless of the floor area of any extension to a premises being provided in conjunction with the septic tank. The Deputy will appreciate that the provision of a septic tank could affect public health and amenity for people living nearby or using an adjacent road.
