asked the Minister for Justice further to his reply to a Parliamentary question on 5th August, 1971, in relation to an incident in Westport, County Mayo, if any action was taken by the Garda authorities in the matter.

This question relates to a complaint that a member of the Garda Síochána, at the request of the management of an hotel, improperly intervened in a dispute between the hotel and the manager of a band.

As the Deputy is aware, the garda concerned has denied that he acted in the way alleged or that he in any other way exceeded his functions.

In view of the unresolved conflict of evidence, the Commissioner, who is the statutory authority in the matter, decided that he would not be justified in taking any action.
