Vol. 261 No. 13

Ceisteanna—Questions. Oral Answers. - Disability Allowance Payment.

9.

asked the Minister for Social Welfare why his Department pays only the marriage rate of disability allowance to a person legally separated from her husband.

The statutory conditions governing payments of disability benefit prescribe that a married woman living apart from and unable to obtain any financial assistance from her husband or who is entitled to an increase for a qualified child or children, or for her husband, is paid benefit at the standard rate. Any other married woman is paid at a special rate. In the case of a woman legally separated from her husband the rate of benefit payable would depend on which of the conditions already mentioned applied in her case.

Does that mean that she can get the full rate for a single woman?

She could in certain circumstances, if the husband from whom she is separated is not contributing.

If I bring a particular case to the Minister's notice will he look into it?
