Vol. 261 No. 13

Ceisteanna—Questions. Oral Answers. - Landlord and Tenant Act.

46.

asked the Minister for Justice if he is aware that the Landlord and Tenant (Amendment) Act, 1971, which became law on 7th December, 1971, had not been published up to 19th May, 1972, and that section 10 of the Act provided a period of one year from the passing of the Act to enable certain small landlords to have their rents revised; if he recognises the hardship being caused to a landlord to whom the Act applies in that he cannot bring an application before the court for revision of rent as he cannot present the law to the courts as contained only in the Act; and in view of the fact that almost half the time permitted has elapsed if he will consider extending the period for making such an application; and if he will take immediate steps to have the Act published and put on sale.

I am not aware of any hardship to landlords of the kind mentioned. The text of the Bill as passed by both Houses of the Oireachtas has been available continuously since its passage and evidence is available from Iris Oifigiúil of the signing of the Bill. In fact, my information is that several cases, both cases under section 10 and other cases, have already been dealt with or are being dealt with in the courts.

I have no official responsibility for the publication of Acts of the Oireachtas but I am informed that the Act, in bilingual form, is expected to be on sale within the next week or so.
