Vol. 267 No. 6

Private Business. - The Leopardstown Park Hospital (Trust Deed Amendment) Bill, 1972: Joint Committee.

The Leopardstown Park Hospital (Trust Deed Amendment) Bill, 1972 from the Seanad.

What is the motion?

It is on the Order Paper. Private Business.

I understand our Whips heard nothing about this. It is not very important but we would like to know what the motion is.

The Leas-Cheann Comhairle should be able to throw some light on this matter.

This is a motion of concurrence in the setting up of a Joint Committee.

The First and Second Stages of the Bill have been agreed to by the Seanad. On completion of the Second Stage the Seanad passed the resolution set out on the Order Paper with a view to having a Joint Committee appointed to consider the Bill.

The motion before the House seeks the concurrence of the Dáil in the Seanad Resolution and, if it is agreed to, the Seanad will be notified accordingly.

The Seanad will then make an Order appointing a Select Committee and later the Dáil will be asked to make a similar order. The two Select Committees thus appointed will be joined and will form the Joint Committee to consider the Bill.

The members of the Joint Committee are nominated by the Joint Committee on Standing Orders (Private Business) which will make its report to each House.

The Chairman of the Joint Committee to consider the Bill is appointed by the Ceann Comhairle and the Cathaoirleach of the Seanad jointly.

In due course the Joint Committee will consider the Bill, and on its issuing a report the Bill will be considered by the Seanad and Dáil in turn on Report and Fifth Stages.

If a discussion is required the practice is to postpone the matter until the following week so that the promoters may brief a Deputy.

I do not see it on the Order Paper.

It is No. 1: Seanad Éireann has passed the following Resolution in which the concurrence of Dáil Éireann is desired:—

That it is expedient that a Joint Committee of both Houses be appointed to consider the Leopardstown Park Hospital (Trust Deed Amendment) Bill, 1972, being a Bill entitled an Act to amend the Trusts of an Indenture of conveyance in Trust dated the 16th day of October, 1917, and made between Gertrude Frances Dunning of the one part and the Right Honourable John Hodge Sir Matthew Nathan and Joshua Albert Flynn of the other part whereby certain lands premises and hereditaments situate at Leopardstown, Carman Hall and Murphystown in the Half Barony of Rathdown and County of Dublin were conveyed upon trust to establish and maintain the Hospital known as the Leopardstown Park Hospital so as to remove restrictions on the class of persons eligible for treatment in the said Hospital, to extend the powers of the Trustees thereof and for other purposes relating thereto.

I move:

That Dáil Éireann concurs with Seanad Éireann in its Resolution communicated to Dáil Éireann on the 11th day of July, 1973, that it is expedient that a Joint Committee of both House be appointed to consider the Leopardstown Park Hospital (Trust Deed Amendment) Bill, 1972.

We have no objection but we got no notice that this was being taken today. That is all I am saying.

Agreed and ordered accordingly.
