asked the Minister for Local Government if he has any proposals to curb noise pollution; and if he will make a statement on the matter.

In so far as my Department are concerned there are a number of provisions aimed at the abatement of nuisance from noise. Section 51 of the Local Government (Planning and Development) Act, 1963, provides with some exceptions that it is an offence for any person to make noise, in a public place or in premises, which is such as to give reasonable cause for annoyance. The planning authority have a general power to prosecute offences under the Act, but any person with grounds for prosecution under section 51 may undertake it. If the source of noise is a private premises, proceedings may not take place unless the noise continues after a warning notice signed by at least three residents or business people in the area has been served.

The Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963, provide that vehicles should be fitted with silencers, make it an offence to use a vehicle in such a way as to cause excessive noise, and control the use of audible warning devices.

Planning authorities have powers under the Local Government (Planning and Development) Act, 1963 to ensure that development likely to be a source of excessive noise is located so as not to injure residential amenities and that buildings are so constructed as to prevent noise nuisance.

The general question of noise pollution is one which will be kept under constant review.

Has the Minister any figures in respect of noise levels in various parts of Dublin city?

That is a separate question. I have not got that information.
