asked the Minister for Industry and Commerce if consumers can claim damages against firms who break EEC competition rules; and if he will make a statement on the matter.

While the EEC competition rules provide for the imposition of fines on firms who infringe them they make no provision for compensation for consumers who may suffer as a result of infringements. It would be a matter for a consumer who felt he had suffered injury as a result of a breach of the competition rules to seek redress under the normal processes of Irish law.

Could we proceed to take action in the Irish courts in a matter like that?

Does the Deputy mean whether I, as Minister, could?

It is very difficult to say. I see no reason in principle why it is not possible, but I would need to have details of particular circumstances where I thought it was warranted.

asked the Minister for Industry and Commerce if holiday makers will be included in any proposed legislation which may be introduced on lines similar to the British Trade Descriptions Act; if such legislation is contemplated; and, if not, why.

asked the Minister for Industry and Commerce if he will ensure that any "all-in" price quoted for a holiday tour will also include airport taxes.

30.

asked the Minister for Industry and Commerce if he proposes to introduce legislation to protect Irish people, who choose to holiday on the European continent, against misleading or dishonest advertisements.

Advertising in relation to holiday travel, accommodation and package tours is one facet of advertising to the consumer to which I shall give consideration in the context of the proposed programme of legislation for consumer protection.
