asked the Minister for Agriculture and Fisheries if a boat confiscated from a person (name supplied) in County Clare for illegal fishing will now be returned.

In accordance with normal procedure the boat in question will shortly be offered for sale by the Limerick Board of Conservators.

Is the Parliamentary Secretary aware that the district justice who tried this case recommended that the boat be returned to the man who was convicted?

I am not so aware. The man was convicted and fined £22.11: £10 for one offence, £12 for the second offence and £11.20 costs. The district justice ordered forfeiture of the boat.

He made a recommendation that the boat be returned to the man.

I did not get any notification that the district justice made such a recommendation.

If I give the Parliamentary Secretary particulars of the case will he reconsider the matter?

Yes, if the Deputy gives me particulars.
