asked the Minister for Social Welfare if he is satisfied with the decision of a medical referee who, in deciding a disability benefit claim for a person, name supplied, in County Kildare, stated that he found him to be 1 per cent incapacitated, as a result of which the person was offered a pension of ten pence weekly increasing to 11 pence per week at a later date.

The person referred to by the Deputy claimed benefit under the Occupational Injuries Act in respect of disablement due to an occupational accident on 4th March, 1974. A medical referee who examined the claimant assessed the degree of disablement at 1 per cent for life and a deciding officer awarded him a gratuity of £63 or the alternative pension mentioned. The award is in accordance with the provisions of the Social Welfare (Occupational Injuries) Act and regulations made thereunder which prescribe the amounts of gratuities and pensions appropriate to varying degrees of disablement. The claimant has appealed against the deciding officer's decision and an oral hearing of his appeal will be held at an early date.
