asked the Minister for Industry and Commerce if he proposes to initiate urgently needed legislation to clarify the position with regard to mineral ownership.

I presume the Deputy is referring to legislation relating to the compulsory acquisition of privately owned minerals in view of the Supreme Court decision regarding a Minerals Acquisition Order made under the existing legislation. This type of legislation involves constitutional issues and is very complicated. My object will be to provide a legal regime which will not deter orderly minerals exploration and development. I am having the whole question examined with a view to devising the most suitable form of legislation to meet the situation.

I would remind the Deputy that at present privately owned minerals can be secured by private treaty and that, where this is not reasonably practicable, there is provision in the existing legislation whereby the right to work such minerals can be secured.
