asked the Minister for Lands if the Land Commission are proceeding to acquire possession of the Glynn estate, Abbeyview, Kilconnell, Ballinasloe, County Galway.

(Cavan): These lands have vested in the Land Commission but as possession is not forthcoming an application has been made to the judicial commissioner for an order for possession under section 19, Land Act, 1927.

It is expected that the application will be heard at an early date.

Could I get an indication from the Minister as to what is meant by "early date"?

(Cavan): I can tell the Deputy that I understand that the application is listed before the judicial commissioner for 9th February.

And there will be a final decision?

(Cavan): It is in his hands as of that date.

This land has been vested in the Land Commission since 20th September, 1974 and early negotiations took place but they will not get possession unless the matter is settled immediately.

(Cavan): As the Deputy knows, this is a case in which the Land Commission had to move against resistance.

That is correct. Can I take it that on 9th February a decision will be taken in the High Court?

(Cavan): I cannot tell the Deputy that. I can only tell him that the case is listed before the Judicial commissioner, who is a judge of the High Court, for hearing on 9th February.

Is this not only a matter of form seeing that the bonds are lodged to the credit of the estate? Must the Land Commission not get possession?

(Cavan): It would be most improper for me to anticipate what will happen in the High Court. I could be guilty of contempt of court.

We will wait until 9th February to see what happens.
