asked the Minister for Lands why a late objection not provided for in the Land Acts was accepted in relation to an estate (details supplied) in County Offaly, although a statutory notice of the price had appeared in Iris Oifigiúil on 27th November, 1975.

In default of agreement the price in this case was fixed and published by the Land Commission. The owner appealed on price but before the matter could be disposed of he indicated that he wished to apply for permission to lodge a late objection to the acquisition proceedings. His application was refused by the Land Commission but was subsequently allowed on appeal to the Appeal Tribunal. I would refer the Deputy to section 15 of the Land Act, 1939. The objection to the acquisition proceedings was lodged on 25th November, 1976, and is at present pending for hearing before the Lay Commissioners.

Meanwhile the appeal on price stands adjourned pending the outcome of the objection.
