asked the Minister for Agriculture and Fisheries when he will be in a position to sign the Oyster Fisheries Order—Clarenbridge 1977.

As I indicated in reply to a similar question on 21st October last legal problems have arisen in connection with the making of this order. These problems are still unresolved but every effort is being made to have matters finalised as quickly as possible.

It is now two years since the Minister agreed to the making of this order and the excuse that legal difficulties are in the way has been used in the period since then. Would the Parliamentary Secretary agree that this excuse is wearing a bit thin? Surely there is sufficient expertise in the Department to overcome the very minor difficulties which, I understood, had in fact been overcome?

I can assure the Deputy that there is no undue delay. Legal problems did arise. I can guarantee that this order will be made but until such time as the legal difficulties are resolved, I cannot sign the order. I have urged those dealing with such legal problems to try to finalise them. Time is passing, but the Deputy can assure the people of Clarenbridge that this order will be made.

Is it not true that the obstacle which was in the way has been overcome and that it is only a matter of drawing up the order to meet the methods suggested for overcoming these difficulties?

My information is that this order differs fundamentally from previous oyster fishery orders. I expect the matter will be finalised shortly.
