asked the Minister for Justice if he is aware that a notice left at the lodgings of a person (name supplied) in Dublin by the Office of the Sheriff of the County Borough of Dublin indicated that the premises would be broken into the following day; and if he will take action, if necessary by the introduction of legislation, to ensure that threatening notices of this kind will no longer be permitted.

The execution of court orders is the responsibility of the sheriff, who in the discharge of his functions in this matter, is answerable to the courts and not to me. I am, however, informed that the issue of notices in the terms used in the particular case mentioned by the Deputy was not authorised by the sheriff and has since been discontinued on his instructions. I should add that the sheriff's duties may on occasion require him to break into premises and a statement of his powers in this regard in notices issued by him is appropriate.
