asked the Minister for Social Welfare why a recipient of disability benefit (name supplied) in County Kerry whose benefit was stopped last August has not yet been allowed benefit again; if he is aware that this person is attending a doctor all the time and his wife and children are suffering because of the nonpayment; and if he will make a statement on the matter.

The disability benefit claim of the person referred to by the Deputy was disallowed from 23rd August, 1976, as medical referees who examined him on 10th August, 1976, and 22nd October, 1976, expressed the opinion that he was capable of work. The claimant has appealed against the disallowance and his appeal will be determined by way of oral hearing. A date for the hearing of the appeal locally as early as possible is being arranged.
