asked the Minister for Social Welfare why a person in Donegal (details supplied) who is suffering from a severe illness has been refused disability benefit.

By a decision of an appeals officer, who held an oral hearing in the case, the disability benefit claim of the person referred to by the Deputy was disallowed on the ground that she was not incapable of work from 30th August, 1976, to 31st December, 1976, the date of the last medical certificate before the appeals officer. The claimant continued to submit medical certificates at monthly intervals and as the certified incapacity is the same as that appearing on her certificates during the disallowed period her claim continues to be disallowed. Another examination by a medical referee is being arranged and the claim will be again reviewed in the light of the medical report on this examination.
