asked the Minister for Tourism and Transport to outline the position regarding the responsibility of CIE for canal maintenance; the names of the canals involved; and if this precludes the leasing of adjacent canal land to recognised community groups for community purposes.

Ownership of the Grand Canal system, including the Barrow Navigation, and the Royal Canal is at present vested in CIE. Apart from a number of branch canals which have been closed, the Grand Canal system is open to navigation, and CIE are responsible for maintaining it in this condition. In the case of the Royal Canal which was closed to navigation in 1961, the board's responsibilities are confined to such matters as the prevention of flooding and liabilities in respect of bridge maintenance.

The leasing of canal lands by CIE to recognised community groups for community purposes would not be precluded provided the leasing was not in conflict with CIE's statutory obligations. Decisions in relation to any such leasing would be a matter for CIE.

As I have already announced the Government have given approval for the transfer of both canals from CIE to the Office of Public Works. Examination of the arrangements and legislation necessary to give effect to the transfer is in train.

May I take it from the Minister's reply that CIE will give priority to the leasing of such lands for local community purposes if such application is made?

It is possible for CIE to make land available and I am sure that they would concern themselves with that aspect.

When may we expect the legislation which the Minister promised the House?

It will be a considerable time before the legislation in relation to this is ready. It is very involved, strange as it may seem. It will take a while before we can formulate it. In the meantime I hope CIE and the Office of Public Works can work out some type of arrangement to co-operate in the development of the canals.

Are discussions on that taking place at present?

I believe they are.

Is the Minister aware that the Minister of State at the Department of Finance said he was not aware of such discussions?

It would be my desire that such discussions should take place.

This matter was waiting for decision for many years. At least I have reached a decision.
