Vol. 323 No. 9

Written Answers . - Undeveloped Turbary .

375.

asked the Minister for Fisheries and Forestry the up-to-date ownership position of plots of turbary which have remained undeveloped for more than 20 years; and if such plots continue in the ownership of those to whom they were originally given or if they revert back to the landowners concerned.

: I presume the Deputy is referring to turbary rights rather than fee simple plots. My Department have been advised that failure to exercise a right of turbary for a long period of years could indicate an intention of abandoning the rights, in which case the turbary would revert to the fee simple owner of the lands. It is understood that 20 years or upwards could constitute such a period.
