asked the Minister for the Environment when he expects to determine the appeal by a person (details supplied) in County Donegal against the Donegal County Council's decision not to grant her certain pension rights on her late husband's service.

The difficulty in this case arose from the fact that the late husband of the person named, being an employee of Donegal County Council who was eligible to become a member of the local authorities widows' and orphans' pension scheme, did not exercise an option to join the scheme when afforded opportunities to do so. The period for the exercise of such options finally closed in September 1979 and consequently it is not now open to the county council to award a pension to his widow under the scheme.

The position in this respect has been explained in reply to correspondence received on her behalf, including correspondence from her solicitor.
