Vol. 333 No. 6

Written Answers. - Court Hearings.

359.

asked the Minister for Justice the number of the following types of actions, on an annual basis, which are set down for hearing at trial in Dublin, in which the parties, or one of them reside within the area comprising Counties Cork, Clare, Limerick and Kerry: family law, chancery and non-jury.

The information sought by the Deputy is not available from existing court statistics and could only be compiled by the expenditure of a disproportionate amount of staff time.

360.

asked the Minister for Justice the incidence of adjournments of trials of non-jury and chancery matters in the High Court by reason of no judge being available on the day on which the case is listed for trial.

There have been no adjournments of such trials for the reason stated. However, in the Michaelmas Term 1981 and the Hilary Term 1982 a number of chancery cases had to be put off because, although advance lists had been arranged on the usual basis of availability of two Chancery judges, a staffing difficulty produced the result that there was only one Registrar available to service the Chancery lists and consequently only one Chancery judge could sit. This situation, which lasted from 3 November 1981 to 12 March 1982, resulted in the adjournment of 36 cases which had firm dates of hearing fixed and 48 cases which had provisional dates for hearing fixed.
