Written Answers. - Sale of Music Tapes.

Mr. Bruton

asked the Minister for Trade, Commerce and Tourism if he will ask the Director for Consumer Affairs to investigate the sale of music tapes to the Irish consumer which are sold as being original recordings when they are not and as being of good quality when in fact they are of such an inferior quality that they damage tape recorders.

As regards false or misleading information, the Director of Consumer Affairs has the power in any case which is brought to his notice to make inquiries and to initiate legal proceedings as appropriate. If the Deputy has any details of such a case, I would suggest that he pass these to the Director.

As regards the quality of goods, under the Sale of Goods and Supply of Services Act, 1980, there is an implied condition in every contract for the sale of goods that these are of merchantable quality and are fit for their intended purpose. Where this is not the case the buyer has the right to seek legal redress.
