Electoral (Amendment) Bill, 1983: From the Seanad.

The Dáil went into Committee to consider an amendment from the Seanad.

I move that the Committee agree with the Seanad in amendment No. 1.:

SECTION 2

1. In page 2, lines 26 to 28, subsection (2) deleted and the following subsections substituted:

"(2) The collective citation `the Electoral Acts, 1923 to 1983' shall include this Act.

(3) The Electoral Acts, 1923 to 1983, shall be construed as one Act."

This is purely a technical amendment to alter the collective citation and the construction contained in section 2 of the Bill which became necessary when the Electoral (Amendment) (No. 2) Bill, 1983, revision of constituencies, was passed before the Electoral (Amendment) Bill, 1983 which deals with votes for British citizens.

I do not have any objection to the amendment, which is purely technical. I should like to avail of this opportunity to remind the Minister, and the House, that we are seriously concerned about the constitutionality of the main proposals contained in the Bill. We expect it will be submitted soon to the courts for decision on its constitutionality.
