asked the Minister for Labour when redundancy payment will be made to a person (details supplied) in County Cork; and if he will take into account the fact that he was on bonus payment and also had the use of a company car when redundancy is being paid.

An application for a statutory redundancy payment was received from the person concerned on 22 November 1984 and is under consideration. The application cannot be dealt with since the person concerned disputes the weekly wage to be used for the purpose of calculating the redundancy lump sum. In these circumstances he should make an appeal to the Employment Appeals Tribunal for a decision on the amount of the weekly wage. A copy of the appropriate form for making an appeal to the tribunal is being sent to the person concerned.

Under the provisions of the Redundancy Payments Acts, 1967 to 1979, a week's pay for the purpose of calculating a statutory redundancy lump sum may, in certain circumstances, take into account such items as bonuses and use of company car. However, where there is dispute as to the reckonability of such items the matter is for decision by the Employment Appeals Tribunal.
