asked the Minister for Defence if he is aware that, under the scheme for Army pensions, where a person is granted a service pension and a disability pension under the Army Pensions Acts, article 38, of the principal scheme the resultant amount payable in respect of the two awards will be the sum of the greater pension and one half of the lesser; and the reason for this restriction.

I am aware of the position as referred to in the Deputy's question.

The principle followed in article 38 of the Defence Forces (Pensions) Scheme, 1937, as amended by article 20 of the amending scheme of 1953, is not peculiar to retired members of the Permanent Defence Force but applies to other retired State servants as well where both service and disablement pensions are payable.
