Vol. 356 No. 6

Written Answers. - Social Welfare Benefits.

454.

asked the Minister for Social Welfare the outcome of an appeal by a person (details supplied) in County Galway against the decision to cancel his unemployment benefit; and the date of the letter written in reply to Deputy Frank Fahey's representations in this case.

The appeal of the person concerned was against the amount of means assessed against him for purposes of his claim to unemployment assistance. An appeals officer also assessed him with means in excess of the statutory limit and disallowed his unemployment assistance claim and he was notified accordingly. According to records in the Department, the reply to representations made by the Deputy issued on 11 July 1984.

455.

asked the Minister for Social Welfare the position with regard to the application for a prescribed relative's allowance made by a person (details supplied) in County Galway.

The application for prescribed relative's allowance in respect of the care and attention being provided by the person concerned for his mother is under investigation at present by the social welfare officer. The social welfare officer visited the pensioner's home on 7 February 1985 but got no reply. It is expected that the inquiries will be completed shortly and the claim will be forwarded to a deciding officer for decision. The pensioner will be notified of the outcome in due course.

456.

asked the Minister for Social Welfare the reason for the delay in providing an oral hearing on the case of a person (details supplied) in County Limerick: and when this hearing will be given.

The unemployment assistance claim of the person concerned was disallowed on the grounds that his means of £38.40 weekly, derived from the profit from his holding exceeded the rate payable. He appealed against the amount of means assessed against him and his case was submitted to an appeals officer for determination. The appeals officer considered that he had sufficient information to decide the case without an oral hearing of the appeal, and on 16 November 1984 he also assessed the applicant with means of £38.40 weekly. Accordingly his claim to unemployment assistance continues to be disallowed.
