I propose to take Questions Nos. 184 and 185 together.

The two employees concerned were awarded payment in lieu of notice by the Employment Appeals Tribunal under the terms of the Minimum Notice and Terms of Employment Act, 1973, against the personal representatives of their former employer who is deceased. As payment of the awards was not forthcoming from the personal representatives, the employees lodged claims with my Department for payment of the awards from the Redundancy and Employers' Insolvency Fund.

Because the death of the former employer predated the operative date of the Protection of Employees (Employers' Insolvency) Act, 1984, there is a doubt as to whether the awards can be paid under the terms of the Act. My Department has sought legal advice on this point. When the legal advice has been received, the two employees concerned will be notified of my Department's decision in regard to their respective applications.
