asked the Minister for Health if he will give specific areas in which the Health (Mental Services) Act, 1981, is inadequate; if so, in what respects; and the changes he proposes to make to it.

asked the Minister for Health if he proposes enacting into law a charter of rights for mental patients, whether voluntary or involuntary; and if he will make a statement on the matter.

asked the Minister for Health if he proposes amending the Mental Treatment Act, 1945, and the Health (Mental Services) Act, 1981, to remove the requirement that compulsorily detained mental patients must first obtain the leave of the High Court before instituting civil proceedings.

asked the Minister for Health the proposals he has for revising the present mental treatment Act.

I propose to take Questions Nos. 86 to 89, inclusive, together.

I have already indicated to the House that I propose to introduce new legislation to replace all the existing Acts governing the psychiatric services. While I do not wish to set out the details of this legislation it is my intention to formulate a Bill which will permit the psychiatric services to develop in accordance with good modern practice.

I believe the 1981 Act did not reflect the approach to psychiatric services which is now generally accepted in developed countries. It was also defective in relation to enabling regulations to be made under some sections. Some provisions of the 1981 Act will almost certainly be retained and there will be adequate protection for the rights of all patients.
