asked the Minister for Labour if he will give the following information in relation to 26 former employees of a firm in liquidation (details supplied) who applied for redundancy moneys on 21 January 1984: (a) the amount of the redundancy payment in each case as appearing from Redundancy Certificate RP2 and the total amount paid; (b) the amount of rebate, if any, claimed by the liquidator in respect of each such employee and the total amount claimed; (c) the amount of rebate, if any, paid by his Department to the liquidator in respect of each employee and the total amount; and (d) the amount of rebate, if any, retained by his Department from payments due under the Redundancy Fund against other liabilities appearing to be payable from the Insolvency Fund in respect of a claim for loss of pay referred to in Labour Court Recommendation No. 8896.

I assume that the 26 employees referred to are those who have been the subject of representations by the Federated Workers' Union of Ireland.

(a) The amounts of statutory redundancy lump sums paid to the 26 former employees concerned are set out, in alphabetical order of the names of the employees on the union list dated 21 January 1985, as follows:

The total amount paid to the 26 employees is £40,556.02.

(b), (c) and (d). As the company concerned was insolvent, the redundancy lump sums were paid direct to the employees from the Redundancy and Employers' Insolvency Fund. The procedure in such cases is that, when the lump sums are paid, my Department submit a claim on behalf of the fund against the assets of the company for the amount of lump sums less the appropriate amount allowed by way of rebate, normally at the rate of 60 per cent of lump sums paid. The liquidator does not, therefore, submit a specific claim for rebate nor is a rebate paid by the Department.

In the case of the company referred to in the question, the amount of rebate allowed in calculation of the Department's claim against the assets was at the rate of 60 per cent of the lump sums paid. The amount of rebate appropriate to each employee was not identified separately but it would be on a pro rata basis related to the amount of each individual lump sum.

My Department have no other application for payment from the redundancy and Employer's Insolvency Fund in accordance with the provisions of the Protection of Employees/Employers' Insolvency Act, 1984, in respect of the 26 employees concerned.

asked the Minister for Labour if he will furnish information on the operation of the Employers Insolvency Act, 1984, in relation to 26 former employees of a firm in liquidation (details supplied) as follows: (a) the amount of normal weekly remuneration in each case, as at 1 January 1984, having regard to the pay recorded on the redundancy certificate furnished to his Department and the provisions of section 6(9); and (b) the estimated cost of the 5 per cent pay increase from 1 January 1984, claimed by the employees and recommended by the Labour Court (No. 8896) and the termination dates as listed on the redundancy forms submitted to his Department and appearing to be payable from the Insolvency Fund by reference to the listed documents.

(b) The information requested is not available to my Department. No formal application in accordance with the provisions of the Protection of Employees (Employers' Insolvency) Act, 1984, has been submitted to the Department. Such application would have to be submitted by the liquidator in the first instance and based on amounts verified by him.
