asked the Minister for Justice if he will clarify if a prison officer within the Irish prison service is entitled to read his own personal file; and, if not, and complaints are recorded, if he is entitled to know the nature of these complaints.

The practice in relation to access by prison officers to their own personal files is the same as that obtaining in the general Civil Service.

The matter has been discussed at general council under the conciliation and arbitration scheme and the position is that it would not be possible to agree to make personal files of staff available to them as this would inhibit Departments unduly in the exercise of their managerial functions. However, my Department are aware of the desirability of ensuring that officers are advised of any adverse reports which might affect their advancement in the service.
