Vol. 365 No. 1

Written Answers. - Statutory Redundancy Payment.

309.

asked the Minister for Labour the reason for the delay in the payment of redundancy payments to a person (details supplied) in County Limerick; when this money will be paid; and if he will make a statement on the matter.

My Department has no record of an application from the person concerned for payment of a redundancy lump sum. I should explain that it is a matter for the employer concerned in the first instance to determine an employee's entitlement to a statutory redundancy lump sum payment in a particular case and to make the payment due to the employee. Should the employee in this case feel that she is entitled to a redundancy lump sum payment, she should, if she has not already done so, write to her former employer asking for payment. If the employer does not accept that there is an entitlement, the employee may appeal to the Employment Appeals Tribunal. If, on the other hand, the employer acknowledges the employee's entitlement through the issue of a redundancy certificate (Form RP 2) but fails or refuses to pay the lump sum, the employee should then apply to my Department for payment from the Redundancy and Employers' Involvency Fund.

I will arrange to have the necessary forms forwarded to the Deputy for the convenience of the employee concerned.
