Vol. 365 No. 4

Written Answers. - Employment Appeals Tribunal.

227.

asked the Minister for Labour if he will arrange to have the balance of compensation awarded by the Employment Appeals Tribunal paid to persons (details supplied) in County Carlow.

The determination of the Employment Appeals Tribunal dated 14 January 1986, in respect of the two persons concerned and one other person was on the basis of an agreement between the parties, the employer and the three workers. The determination does not, however, break down the compensation awarded between awards under the Unfair Dismissals Act, 1977, the Minimum Notice and Terms of Employment Act, 1973, and the Redundancy Payments Acts, 1967 to 1984. Such a breakdown is necessary in order to enable the question of payments under the individual Acts to be pursued.

As the company by which these persons were formerly employed is in liquidation, the question of payment of their entitlements under the Protection of Employees (Employers' Insolvency) Act, 1984, arises. One of the workers named by the Deputy has applied for payment under that Act and I propose to refer his case to the Employment Appeals Tribunal for clarification of the details of his award. If the other workers make similar applications through the liquidator, I will consider referring their cases also to the tribunal.

I will keep the Deputy advised of developments.
