Vol. 367 No. 2

Written Answers. - Statutory Redundancy Entitlements.

105.

asked the Minister for Labour if any further payments can be made to former employees of Celtic Ceramics, Kilrush, County Clare who have not received their full entitlements arising from the closure of the plant.

According to my Department's records, all the former employees of Kilrush Pottery Limited (trading as Celtic Ceramics, Kilrush, County Clare), have been paid their full statutory redundancy entitlements under the terms of the Redundancy Payments Acts 1967-84.

The Deputy may be referring to the possibility of payment of other outstanding entitlements to the employees concerned under the Protection of Employees (Employers' Insolvency) Act, 1984. However that Act applies only to insolvencies which occurred on or after 22 October 1983 whereas the firm in question was put into receivership and the employees were made redundant before that date. In the circumstances, the provisions of the Act do not apply and there is no provision otherwise for payment of entitlements from State funds. The employees, however, can claim their entitlements from the receiver and manager of the firm.
