asked the Minister for Finance the present position in the case of a person (details supplied) in Dublin 13 who is being assessed for tax on earnings received under the enterprise allowance scheme; and if he will make a statement on the matter.

Payments of the kind mentioned in the Deputy's question have always been considered as trading receipts in the computation of profits for tax purposes. The tax treatment of such payments is now under examination in the light of the decision in a recent appeal case and, until that examination is completed it is not possible to give a definitive answer as to their tax status.
