Written Answers. - Provision of Statutory Instrument.

asked the Minister for Justice if he will provide as a matter of urgency the necessary statutory instrument incorporating Rules of Court providing for the procedural working of section 5 of the Courts (No. 2) Act, 1986, relating to the enforcement of District Court orders made pursuant to the Guardianship of Infants Act, 1964; if he will state when such statutory instrument will be made; and if he will make a statement on the matter.

No statutory instrument falls to be made by me in relation to the provision mentioned.

The relevant rule making authority, namely, the District Court Rules Committee, is empowered to consider the practice, procedure and administration of the District Court and the law affecting and administered by that court. While section 5 of the Act, as it is enacted, is already in operation, it is understood that procedural aspects of the section and that of guardianship generally are to be examined by the committee and, should they consider it necessary, they will no doubt draw up new rules for my concurrence in the ordinary way.
