asked the Minister for Justice the plans, if any, he has to amend section 39 of the Offences Against the State Act, 1939 to ensure that henceforth only serving judges will be allowed to sit on the Special Criminal Court.

As has been indicated to the House on a number of occasions in the past I could not, in the context of parliamentary questions, say whether I have proposals for legislative changes in particular areas. Such proposals are announced, in the ordinary way, only after Government approval. However, I must say that from a practical point of view I cannot see any need for the amendment suggested by the Deputy — only serving judges sit on the court at present and there is no question as far as I am aware of any proposal to change that.
