Vol. 375 No. 1

Written Answers. - Statute of Limitations.

37.

asked the Minister for Justice the plans, if any, he has to amend section 49 of the Statute of Limitations 1957 in view of the fact that as a result of a Supreme Court decision (details supplied) in 1971, the limitations period for personal injuries actions brought by infants could approach periods as long as 21 years.

I have just received a copy of the recently published report of the Law Reform Commission entitled Report on the Statute of Limitations: Claim in Respect of Latent Personal Injuries. This contains, among other things, a recommendation that section 49 of the Statute of Limitations be amended. I will give full and careful consideration to this report, but I cannot say at this stage what legislative proposals, if any, I will be putting before the Government.
