asked the Minister for Social Welfare if a person (details supplied) in County Kildare will qualify for an invalidity pension on the basis that he is unlikely to be fit to work again; and if he will make a statement on the matter.

The person concerned appears to satisfy the medical and contribution conditions for invalidity pension. It will be necessary for him to formally apply for the pension and a claim form has now been forwarded to him.

asked the Minister for Social Welfare when a person (details supplied) in County Kerry will be called again before an appeals officer or an independent medical referee, in support of her application for continued payment of disability benefit in view of the serious nature of her illness; and if he will make a statement on the matter.

The person concerned was paid disability benefit from 18 December 1981 to 4 July 1987.

Payment was disallowed from 6 July 1987 following examination by a medical referee who expressed the opinion that she was capable of work. She appealed against the disallowance and was examined by a different medical referee who also expressed the opinion that she was capable of work.

As the result of an administrative error, the claimant was not issued with a form on which to set out the grounds of her appeal. This form has now been issued to her and when it is returned, her case will be submitted to the chief appeals officer for consideration.
