asked the Minister for Social Welfare if he will now ensure that a claim to industrial injury benefit is allowed in the case of a person (details supplied) in Dublin 12 who has been on disability benefit since 13 April 1987 and whose claim to injury benefit is clearly justified since the accident took place while he was executing the duties of his employment.

The person concerned claimed occupational injury benefit from 13 April 1987 in respect of an incapacity resulting from an alleged accident at work on 16 March 1987. Pending the completion of investigations, he was awarded disability benefit on an interim basis and this was paid to 7 November 1987, after which he was certified fit to resume work by his own doctor.

Investigations revealed that his employers were not satisfied that an occupational accident had happened as alleged. In the absence of evidence of an accident, the claim was disallowed on 24 September 1987 on the grounds that the incapacity was not caused by an accident arising out of, and in the course of the employment. The person concerned has appealed against the decision and the case has been referred to an appeals officer for determination.

asked the Minister for Social Welfare the reason disability was discontinued in the case of a person (details supplied) in County Clare since his Department's medical team have all the relevant information on the illness this person suffers.

The person concerned did not attend for examination by a medical referee of the Department on 30 October 1987 and was disallowed for the statutory period of nine weeks. He has not submitted an explanation for his non-attendance for examination. Arrangements are now being made to have him examined by a medical referee at the earliest possible date and his claim to benefit will be reviewed in the light of the medical referee's report.
